The Kennesaw firm explains what Georgia law requires at a DUI stop, what drivers can say no to, and what to do after an arrest.

A DUI stop in Georgia comes with a short list of things a driver must do and a longer list of things a driver does not have to do. The Freedom Lawyers, a criminal defense firm with an office in Kennesaw, Georgia, is sharing a plain-English guide to both, so drivers know their rights before they ever see blue lights.
Some steps are required. A driver who is pulled over has to stop safely, hand over a driver’s license, registration, and proof of insurance, and follow basic instructions such as stepping out of the car. Past that point, the required list gets short. Drivers do not have to answer questions about where they were coming from or how much they had to drink. Police also do not read Miranda rights before a DUI investigation, so questions at the car window can come before any warning.
The roadside tests are optional. In Georgia, field sobriety tests, such as walking a straight line or standing on one leg, are voluntary. A driver can say no. The official breath, blood, or urine test after an arrest works differently. Under Georgia’s implied consent law, refusing that state test can lead to the loss of a driver’s license.
Thomas Flugum, founder of The Freedom Lawyers, previously worked for the Fulton County Solicitor’s Office, where he handled DUI, drug, theft, and other cases for the State. Today he uses that experience on the defense side. Flugum has taken more than 30 cases to a jury. He has been a Super Lawyers Rising Star since 2023 and a National Trial Lawyers Top 40 Under 40 honoree since 2022, and Expertise.com named him one of its Best DUI Lawyers in 2022.
The Freedom Lawyers takes a trial-first approach, and every DUI case is prepared for trial. Clients reach an attorney directly, not a secretary, and often get a call back within the hour.
